A former Dresden auxiliary police officer was released from prison on Wednesday, July 12 after a judge granted his attorney’s motion for judicial release.
Fran Tosi Ward of Koffel Brininger Nesbitt, former officer Matthew Prince’s attorney, argued that her client’s offense occurred two decades prior, and that he pleaded guilty, cooperated with authorities and admitted his wrongdoing.
In February of this year, Prince was sentenced to 11 months in prison for the possession of VHS tapes that contained footage of minors in sexual situations.
Common Pleas Judge Mark Fleegle granted the judicial release, and Prince was placed on probation for two years and ordered him to complete 50 hours of community service.
19 VHS tapes were turned in to the Muskingum County Sheriff’s Office on July 10, 2015. The tapes contained footage of two underage victims involving sexual contact in various states of nudity. Prince was seen on the tapes adjusting the camera.
According to Assistant Muskingum County Prosecutor John Litle, the time between the tape’s production and their discovery was far longer than the statute of limitations for these types of tapes, which is six years. This affected the plea agreement and the charges.
