Attorneys at Koffel Brininger Nesbitt were able to successfully negotiate former
Newark High School teacher Anthony Miller’s early release from prison.
Attorney Brad Koffel worked tirelessly to negotiate a plea for our client, Anthony Miller,
which put him in the most favorable position for
early release from prison. Any prison term in Ohio under 60 months allows a judge to reconsider
the sentence after serving just six months.
Koffel Brininger Nesbitt recommended to our client that he wait until he served
12 months before requesting early release. Today, in his 17th month, KLF’s
Attorney Fran Ward was successful in having
Anthony Miller released from an Ohio prison despite the objections of the State of Ohio.
In 2014,
Miller was sentenced to four years and 10 months in prison (58 months, just under the 60-month
threshold) after being convicted of nine felonies and four misdemeanors
relating to misconduct with some of his students.
Attorney Fran Tosi Ward argued before
Licking County Common Pleas Court Judge David Branstool last week, saying that after
serving 17 months in prison and having to
register as a sex offender for life is sufficient punishment. Ward also emphasized Miller’s
initiative to change, taking advantage of rehabilitation programs and
showing true remorse for his past conduct.
When Judge Branstool announced his decision to release Miller from prison,
he emphasized that it in no way diminishes the magnitude of what the victims
suffered, nor the severity of Miller’s actions. The decision, he
says, was based on four factors: Miller does not have an extensive criminal
history prior to this, the offenses were lower-level felonies, Miller
willingly participated in prison rehabilitation programs, and Miller had
no disciplinary problems while imprisoned.
