COLLEGE STUDENT AVOIDS PRISON IN COMPLEX SOCIAL MEDIA OBSCENITY CASE
Our client, a 20-year-old college sophomore, was home for Thanksgiving break when he clicked on an Instagram advertisement promoting an opportunity to “make money from home.” The link led to an online platform where users could create accounts and monetize adult content. Over the next four months, the client became involved in selling digital content he believed to be legal young adult erotica. Some of the material in circulation on the platform also contained unlawful images, including suspected CSAM (Child Sexual Abuse Material). A forensic report later confirmed that the one flagged file had been automatically blocked by Dropbox and was never transmitted. Despite these mitigating facts, the State of Ohio pursued a 50 count indictment for pandering in child pornography under Ohio R.C. 2907.321, 2907.322, and 2907.323. The prosecutor refused to consider lesser resolutions and demanded a 10-year prison term at sentencing. Our defense team fought back. We retained a nationally recognized forensic computer expert from Arizona, comprehensive psychological evaluations and presented substantial mitigation material for the judge’s consideration. At sentencing, the Court rejected the State’s request for 10 years in prison and imposed probation.
